Der Gesetzgeber fordert, dass, wer Leistungen beantragt oder erhält, alle Tatsachen anzugeben hat, die für die Leistungsgewährung erheblich sind. Wer dieser Mitwirkungspflicht nicht nachkommt, muss damit rechnen, dass die beantragte bzw. gewährte Leistung ganz oder teilweise versagt bzw. entzogen wird (§§ 60, 66 SGB I).
Das dürfen Jobcenter nicht! So weit so gut. Allerdings kommt es immer wieder vor, dass Behördenmitarbeiter von sich aus Fragen stellen, die Leistungsberechtigte nicht beantworten müssen. So fragten unlängst Jobcenter-Mitarbeiter per Fragebogen nach Sexualpartnern. Andere kopierten den Personalausweis, ohne hierfür eine Berechtigung zu haben. Wem also Fragen als zu intim empfindet, sollte sich an den Datenschutzbeauftragten des Landes wenden, damit dieser die Fragen beurteilt.
Muss ich eigentlich Fragen beantworten, wenn Unbefugte zuhören? Nein! Sie haben einen gesetzlichen Anspruch auf Diskretion (§§ 35 SGB I, 78a SGB X). Der Empfangsbereich eines Amtes muss so organisiert werden, dass Sie Ihre Wünsche äußern und Ihre persönlichen Angaben machen können, ohne dass Unbefugte mithören können. Das gleiche gilt für Büroräume mit mehreren Arbeitsplätzen. Bitten Sie darum, das Gespräch in einem separaten Raum zu führen. Ein geschulter Mitarbeiter wird daher auch nicht mit Dritten telefonieren, solange Sie im Raum sind.
