Rechtswidrig: Im Zuge der Softwareumstellung soll es künftig im Jobcenter des Landkreises Göppingen nicht mehr möglich sein, einen Vorschuss zu erhalten

Laut „Kundeninformation für Leistungsempfängerinnen und Leistungsempfänger des SGB II“ (Hartz IV) des Jobcenters im Landkreis Göppingen soll es im Zuge der Softwareumstellung auf das neue System „Allegero“ zukünftig nicht mehr möglich sein, einen Vorschuss zu bekommen. Der Arbeits- und Sozialrechtler Harald Thomé weist daraufhin, dass eine solche Praxis rechtswidrig ist. Denn Hilfebdürftige haben ein Anrecht auf schnelle Hilfe, wenn akute Not besteht. Doch bürokratische Gründe sind mal wieder wichtiger.
Keine Vorschüsse mehr für Hartz IV-Bezieher im Landkreis Göppingen? Jeder Leistungsbezieher hat das Recht auf einen Vorschuss. In § 42 Abs. 1 SGB I heißt es dazu: „Besteht ein Anspruch auf Geldleistungen dem Grunde nach und ist zur Feststellung seiner Höhe voraussichtlich längere Zeit erforderlich, kann der zuständige Leistungsträger Vorschüsse zahlen, deren Höhe er nach pflichtgemäßem Ermessen bestimmt. Er hat Vorschüsse nach Satz 1 zu zahlen, wenn der Berechtigte es beantragt; die Vorschusszahlung beginnt spätestens nach Ablauf eines Kalendermonats nach Eingang des Antrags.“
In § 37 S. 1 SGB I ist zudem geregelt, dass von diesem Recht abgewichen werden kann, sofern es gesetzlich vorgeschrieben ist. Im SGB II gibt es Thomé zufolge aber keine solcher Abweichungen. Folglich ist die Information des Jobcenters im Landkreis Göppingen, dass zukünftig keine Vorschüsse mehr für Hartz IV-Bezieher gewährt werden können, rechtswidrig. Betroffene sollten auf ihr Recht beharren, sofern sie einen Vorschuss benötigen, und dieses – falls notwendig – auch juristisch durchsetzen. (ag)
