Eine Bank darf in ihren Allgemeinen Geschäftsgebühren keine Zusatzgebühren für die Umwandlung eines allgemeinen Girokontos in ein Pfändungsschutzkonto (sogenanntes P-Konto) erheben. Mit Urteil vom heutigen Tag gab der 2. Zivilsenat des Schleswig-Holsteinischen Oberlandesgerichts einer entsprechenden Klage des Bundesverbandes der Verbraucherzentralen und Verbraucherverbände gegen eine Direktbank mit Sitz in Schleswig-Holstein statt.
Banken sind seit dem 1. Juli 2011 verpflichtet, auf Antrag des Kontoinhabers ein Girokonto in ein Pfändungsschutzkonto umzuwandeln. Greift ein Gläubiger durch Kontopfändung auf das Kontoguthaben des Schuldners zu, verbleibt dem Schuldner bei einem Pfändungsschutzkonto (P-Konto) der monatliche Betrag zur Existenzsicherung (Pfändungsfreibetrag) auf dem Konto, über den er dann verfügen kann. Seit dem 1. Januar 2012 können Schuldner nur noch mit Hilfe eines Pfändungsschutzkontos ihr Kontoguthaben vor Pfändungen schützen Die nach der früheren gesetzliche Regelung (§ 850k ZPO a. F.) bestehende Möglichkeit einer Aufhebung der Pfändung durch das Vollstreckungsgericht ist entfallen. Auch die Verfügung über eingehende Sozialleistungen kann der Schuldner sich bei einem debitorisch geführten Konto nur noch durch die Umwandlung in ein Pfändungsschutzkonto sichern.
